I General information and definitions

1. These Terms and Conditions set out the rules for using the online shop available at www.frra.pl

2. These Terms and Conditions constitute the terms and conditions referred to in Article 8 of the Polish Act on Providing Services by Electronic Means.

3. The owner of the shop www.frra.pl, also referred to as the Seller, is:

4. All products sold by Brigatta Małgorzata Wiatr are new and free from physical and legal defects.

5. A sales contract may be concluded by placing an order via the website www.frra.pl

6. The contract is concluded when the Seller confirms that the order has been accepted for processing.

7. The terms used in these Terms and Conditions mean:

a) Customer – a natural person, a legal person or an organisational unit without legal personality that is granted legal capacity by specific provisions, which places an Order in the Shop;

b) Civil Code – the Polish Civil Code Act of 23 April 1964 (Journal of Laws No. 16, item 93, as amended);

c) Terms and Conditions – these Terms and Conditions for the provision of electronic services within the online shop www.frra.pl

d) Online Shop – the website available at www.frra.pl through which the Customer can place orders.

e) Sales contract – a contract for the sale of Goods within the meaning of the Civil Code, concluded between Brigatta Małgorzata Wiatr and the Customer via the website www.frra.pl

f) Act on Providing Services by Electronic Means – the Polish Act of 18 July 2002 on providing services by electronic means (Journal of Laws No. 144, item 1204, as amended).

g) Order – the Customer's declaration of intent aimed directly at concluding a Sales contract, specifying in particular the type and quantity of the Goods.

II Placing orders

1. Orders can be placed 24 hours a day.

2. To place an order in the online shop www.frra.pl, you need to:

• add the selected product to the cart

• choose a payment method

• enter the delivery address

• place the order by clicking the “ORDER” button

3. While placing the order, the Customer chooses the payment method and is informed of the total price of the order.

4. Processing of the Order begins when the payment is received in the Seller's bank account.

5. Order processing time is 5 to 14 working days and does not include shipping.

6. Ordered goods are delivered by shipping companies.

7. On receiving the product, the buyer should check, in the presence of the person delivering the goods, that the parcel is complete and shows no damage that may have occurred in transit. If damage is found, a damage report must be drawn up in the presence of the carrier.

III Payment methods

1. The Customer should pay for the order within 3 days of placing it.

2. The Seller accepts the following payment methods:

• prepayment to the Seller's account by traditional bank transfer, account number for transfers: 79 1140 2004 0000 3902 7522 7270; the order is processed once the payment has been credited to the Seller's account

• PayPal payments – the Customer pays for the purchase while placing the order.

If funds need to be refunded for a transaction made by the customer with a payment card, the seller will make the refund to the bank account linked to the Ordering Party's payment card.

IV Right of withdrawal

Every customer who is a consumer within the meaning of Article 22¹ of the Civil Code and uses the online shop www.frra.pl has – under the law – the right to withdraw from the concluded contract for the purchase of goods, without giving any reason, within a period not exceeding 14 days.

To exercise the right of withdrawal, the Customer must inform the Seller by email at: contact@frra.pl

The product returned by the Customer should be properly protected against damage during transport.

The costs of returning the goods are borne by the customer.

V Warranty

1. All products offered by the website www.frra.pl are covered by a warranty on the terms set out in the Civil Code

2. Complaints do not cover:

natural wear and tear of the product

use not in accordance with the product's intended purpose

improper care

mechanical damage

products with obvious defects that the buyer was aware of on the day of purchase.

3. Brigatta is not liable for damage or losses resulting from improper use of the product sold.

4. The goods subject to the complaint, together with a detailed description of the complaint, should be sent to: Brigatta Małgorzata Wiatr

5. Brigatta will process complaints within 14 days of receiving the product concerned.

6. If the complaint is accepted, a fully functional product will be sent to the address provided by the Customer. If an exchange is not possible, the Seller will refund the amount due to the Buyer's account within 14 working days.

VI Privacy policy and personal data security

The controller of the personal data provided by the shop's Customers is the Seller.

The Seller undertakes to protect personal data in accordance with the Polish Personal Data Protection Act of 29 August 1997 and the Act on Providing Services by Electronic Means of 18 July 2002.

By providing their personal data to the Seller when placing an order, the Buyer consents to its processing by the Seller for the purpose of fulfilling the order.

The Buyer may at any time access, correct, update and delete their personal data.
